Lakewood Assisted Living Employee Charged with Negligence Causing Bodily Injury to Two Elderly Residents

GOLDEN, Colo. (July 1, 2026) — Ashley Ann Garcia, 35, a former caregiver at a Rocky Mountain Assisted Living Facility (RMALF), has been arrested and charged in connection with two separate incidents that allegedly involved neglect and resulted in bodily injury to two elderly residents. Garcia worked at the Lakewood Memory Care location on Saulsbury Street as a Qualified Medication Administration Personnel (QMAP), responsible for administering medication and providing caretaking support.

On July 2, 2025, Lakewood police responded to the RMALF after a woman reported that her grandmother, a memory care resident, had suffered a severe skin tear on her forearm, noting that skin was missing from above the elbow down to nearly the wrist. The victim, who was 100 years old at the time, sustained serious bodily injury and required hospitalization. The family member had been told the injury occurred during a fall as the victim was being assisted off the floor, but the reporting party believed the circumstances were suspicious.

While on scene, police were notified of a second incident, which is alleged to have occurred only twenty-four hours prior, and involved an elderly male memory care resident. Between the evening of June 30 and the morning of July 1,2025, the male victim experienced three falls while in Garcia’s care. After Garcia assisted the resident the first two times, after his third fall, Garcia is accused of leaving the resident on the floor for nearly four hours, wearing only a diaper. The victim also sustained an injury to his arm during that time.

According to the investigation, in that incident, Garcia failed to follow required protocol, including the use of a gait belt and calling 9‑1‑1 for a lift assist. RMALF terminated her employment as a result and a report was made to Adult Protective Services (APS). Investigators later learned Garcia had been employed at the facility for less than 30 days.

Following the investigation by the Lakewood Police Department, on February 3, 2026, the First Judicial District Attorney’s Office filed two felony charges against Garcia: one count of Negligent Serious Bodily Injury to an At-Risk Person (Victim 1) and one count of Negligent Bodily Injury to an At-Risk Person (Victim 2). An arrest warrant was issued the same day.

On June 9, 2026, Lakewood Police Agents located Garcia at her new place of employment, The Ivy Castle Rock, an assisted living and memory care facility. Garcia was taken into custody on the warrant and later released on a $5,000 Personal Recognizance bond.

Garcia made her first court appearance on June 22 in Jefferson County Court for advisement of charges. She is due again in court on July 22 at 10:00 AM.

COUNT 2: NEGLIGENT BODILY INJURY TO AN AT-RISK PERSON (F6), §18-6.5-103(2)(c) 

The filing of criminal charges is a formal accusation that a defendant committed a crime under Colorado law. All defendants are presumed innocent unless and until proven guilty beyond a reasonable doubt.
