Man Charged with Vehicular Homicide Following Fatal E-Scooter Crash in Lakewood

GOLDEN, Colo. (Sep 11, 2026) — The First Judicial District Attorney’s Office has charged Joseph Sutter, 33, of Lakewood, with vehicular homicide and reckless driving after he allegedly struck and killed a 17-year-old riding an e-scooter in late August.

On August 29, at approximately 1:42 a.m., Lakewood Police responded to the intersection of South Wadsworth Boulevard and West Mexico Place following reports of a vehicle-pedestrian collision. Upon arrival, Agents discovered an individual lying in the southbound lanes with severe injuries and no signs of life.

The victim was identified as a 17-year-old boy who was pronounced deceased at the scene by medical personnel. Due to the victim’s age, we are not releasing his name. 

According to the affidavit, witnesses observed a Tesla traveling at a high rate of speed as it approached the intersection, striking the scooter rider.  

Agents located the Tesla in a nearby parking lot. Significant damage was noted to the front windshield and lower bumper, consistent with a collision involving the scooter. The lower portion of the scooter was found dislodged near where the Tesla stopped at 7655 W Jewell Ave. The driver of the Tesla, who remained with the vehicle, was identified as Joseph Sutter.

Further investigation determined the initial point of impact was just north of Colorado Drive, with the victim’s body found south of Colorado Drive. At 1:36 a.m., traffic camera footage showed the victim, who was riding home from work, transitioning from the sidewalk to the southbound #2 lane of S Wadsworth Blvd. According to the affidavit, the Tesla was traveling approximately 79mph through the intersection at the point of impact, while the posted speed limit was 40mph.

On September 3, a warrant was issued for Sutter’s arrest and he was taken into custody by Lakewood Police. Sutter later posted his $5,000 cash/surety bond, under the standard terms and conditions, as well as a specific prohibition against operating any motor vehicle while released on bond.

On September 8, the First Judicial District Attorney’s Office filed the following charges:

  • Count 1: VEHICULAR HOMICIDE, C.R.S. 18-3-106(1)(a) (F4)
  • Count 2: RECKLESS DRIVING, C.R.S. 42-4-1401 (T2)

Sutter is scheduled for his first court appearance today, September 11, at 10:00 a.m.

The criminal court case is 2026CR001730. 

The filing of criminal charges is a formal accusation that a defendant committed a crime under Colorado law. All defendants are presumed innocent unless and until proven guilty beyond a reasonable doubt.
